The fine, approximately $1.2 million USD, was imposed for unfair commercial practices targeting children in Fortnite. This action highlights increasing regulatory scrutiny.
The Netherlands Authority for Consumers and Markets (ACM) has imposed a fine of approximately $1.2 million on Epic Games for utilizing unfair commercial practices within the game Fortnite. The regulator concluded that the company exploited the vulnerabilities of children through aggressive in-game advertising and manipulative design choices in its Item Shop. This enforcement action highlights the growing regulatory scrutiny regarding how digital platforms monetize younger audiences through psychological pressure tactics.
The total penalty of €1,125,000 is divided equally into two charges of €562,500 each. The first fine addresses the use of direct exhortations for children to make purchases, which the ACM classified as an illegal aggressive commercial practice. The second fine targets the use of misleading countdown timers, which the regulator determined created a "fear of missing out" (FOMO) to pressure users into impulsive spending.
Beyond the financial penalty, the ACM issued a binding instruction requiring Epic Games to rectify these practices by June 10, 2024. In response, the company has committed to several operational changes, including the removal of countdown timers and the implementation of clearer, local-time-based information regarding item availability. Furthermore, Epic Games has pledged to restrict the presentation of items to users under the age of 18 in the Netherlands, ensuring that only products available for at least 48 hours are displayed to that demographic. This case underscores the ongoing efforts by European regulators to enforce strict consumer protection standards within the gaming industry.
