This shifts the burden from app store ecosystems directly to the publisher.
Mobile game publishers transitioning to direct-to-consumer (DTC) sales models face significant tax compliance risks that, if mismanaged, can result in substantial financial penalties. The primary thesis is that while bypassing traditional app store ecosystems allows publishers to capture a larger share of revenue, it shifts the entire burden of global sales tax, VAT, and consumption tax compliance onto the developer. A notable example of these risks is the $23 million penalty levied against Epic Games by Japanese tax authorities for failing to declare income from microtransactions between 2018 and 2020.
The operational requirements for maintaining compliance are extensive and vary by jurisdiction. Publishers must research regional tax laws, establish local business entities, register with tax authorities in every territory where they operate, and implement systems to calculate and collect complex, multi-layered taxes—such as federal, state, and city-level levies—for every individual transaction. Furthermore, publishers are responsible for maintaining meticulous records and filing accurate, localized tax reports on a monthly or quarterly basis, often in different languages and formats.
Because of the high administrative and financial burden, including the necessity for specialized legal and accounting support, the industry is increasingly turning to Merchant of Record (MoR) services. These third-party providers manage the end-to-end compliance process, including entity creation, tax calculation, collection, and reporting. By outsourcing these functions, publishers can mitigate the risk of human error and regulatory non-compliance while focusing on scaling their web store revenue. This shift highlights the growing complexity of global digital commerce as game developers move away from the centralized payment ecosystems of major mobile platforms.
